That Iraq Constitution Quagmire

I'm doing my best to understand the details of the Iraqi constitution and the issues at hand. I am also alternately getting angry while being hopeful.

Not to mention, not unlike American politicians, the Iraqi Sunni, Shiite and Kurd representatives are giving their version of the progress, or lack of, as regards developing the Iraqi constitution.

Below are the three major issues that are alleged to be the current sticking points on the constitution.

-federalism, and the way to form [federal] regions

-the terminology used in eradicating the influence of the former Baath regime - whether to use the term Baath party or Saddam's Baath

-structuring of authority between the presidency, parliament and the government.


Let's begin with the timeline and how it works.

Last week, 8/15/05, representatives of all of the Iraqi population were charged with submitting a draft constitution to the Iraqi parliament. Said parliament having been elected on the day of the "purple fingers". The Sunni population boycotted that election and thus do not have as many representatives in the parliament as they could have.

It was the Sunnis, and the Baath party, who ran Iraq with a little help from Saddam Hussein. They are the minority in Iraq and resent the loss of their former elite positions. They are also comprise the majority of the so-called "insurgents" in Iraq. Of course they have a bunch of Saddam's oil-for-palaces money and a little help from other sons of camels who don't want Iraq to become a democracy.

The elected parliament is allowed to give the constitution committee extra time, which they did last week.

Rumor and scuttlebutt has it that the Sunnis are obstructing the final draft of the constitution because hey, if it only takes a little refusal to negotiate without the bother of bombs to derail Iraqi democracy, well why not?

Yesterday a draft was given to the Iraqi parliament, which has three days to debate and discuss before a vote to accept. If the Iraqi parliament does not vote to accept the draft constitution then the parliament is dissolved and another one must be voted in.

If the Iraqi parliament does accept the draft constitution, then it will be put to a vote by the Iraqi people. If three provinces reject the proposed constitution by a 2/3's majority vote than it is back to the drawing board.

The Sunnis have the ability to block passage of the constitution by popular vote as they easily have control of three of the provinces.

Now by the listing above, the alleged three things still undecided about the Iraq constitution, none of them seem to be about the implementation of Sharia law or the adoption of Islam in the social order.

All issues being bandied about by the liberal media as if written in stone. Of course, that listing of constitutional issues could be the spin of one faction or another.

For there is some deep truth to the notion that the American people will not be happy if a)over 1800 of our American youth died to create a government where women cannot vote or b)over 1800 of our American youth died to create yet another Arab government where the extremism of Islam can be used to "govern" the helpless and maintain the power of a few.

So the Iraqi parliament now has the ball and it is in their court. It would seem that the Sunnis were not even part of negotiations this past week. The parliament can now debate the issues and form the draft that will be voted upon. As in the past popular vote, the Sunni faction can exclude themselves from the entire process or hey, they could act right.

Just a thought.
